Terms of Service
These terms govern your use of CookCart, operated by [operating company](“we”, “us”). By creating a kitchen on CookCart you agree to them.
1. What CookCart is
CookCart is software. We are not a food business, a restaurant, a delivery service or a marketplace. We provide a tool that lets an independent home cook take orders from their own customers.
Specifically, we do not:
- cook, handle, store, package or deliver any food;
- employ, supervise or direct cooks, who are independent of us;
- find customers for cooks, or introduce diners to cooks;
- list, rank, recommend or compare cooks anywhere;
- set prices, menus, delivery areas or opening hours;
- receive, hold or transmit money paid by a diner to a cook.
A diner reaches a cook only through a link, QR code or ID that the cook has given them. There is no public directory of cooks and we do not operate one.
2. If you are a cook
You are responsible for your own food business. That includes:
- Food safety and licensing. You must hold whatever registration the law requires of you. In India a home cook below the prescribed turnover generally registers with FSSAI as a Petty Food Business Operator. Meeting that obligation is yours, not ours.
- Your food. Its quality, hygiene, accuracy of description, allergen information and fitness to eat.
- Your prices, and the tax on them.
- Delivery, where you offer it, and anyone you engage to do it.
- Your customers. Finding them, serving them, and resolving complaints, refunds and disputes with them directly.
- Your diners’ personal information, which you receive through CookCart and must handle lawfully.
You must not use CookCart to sell anything other than food you have prepared, to break any law, or to impersonate anyone.
3. If you are a diner
Your order is a contract between you and the cook. We are not a party to it. Questions about your food, your delivery, a refund or a complaint go to the cook, whose contact details are on their page.
Payments you make go directly to the cook, by UPI to their own account or in cash. We never receive that money and cannot refund it.
4. Plans and payment
A new kitchen may take its first 30 orders at no charge. After that, continuing to take orders requires a subscription at ₹450 per month.
The subscription is the only money we receive, and it is paid by the cook, not the diner. We take no commission on any order. See our refund policy.
5. Your content
Your kitchen name, menu, descriptions and photographs remain yours. You give us permission to store and display them for the purpose of running your ordering page, and nothing else. You confirm you have the right to use any photograph you upload.
We may remove content that is unlawful, or that is not what this service is for.
6. Availability
We try to keep CookCart running, but we do not promise it will be uninterrupted or error free. We may change or discontinue features. If we discontinue the service entirely we will give reasonable notice and let you export your data.
7. Liability
Because we do not prepare, handle or deliver food, we are not liable for the food — including illness, allergic reaction, quality, lateness or non-delivery. Those are matters between the diner and the cook.
To the extent the law allows, our total liability to a cook for any claim is limited to the subscription fees that cook paid us in the three months before the claim. We are not liable for lost profits or lost business.
Nothing here limits liability that cannot lawfully be limited.
8. Ending it
You can stop using CookCart at any time and cancel your subscription from your dashboard. We may suspend or close an account that breaks these terms, or that we reasonably believe is being used unlawfully or is putting diners at risk.
9. Changes
We may update these terms. If a change materially affects cooks we will give notice by email before it takes effect. Continuing to use CookCart after that means you accept the change.
10. Law
These terms are governed by the laws of India, and the courts of Chennai, Tamil Nadu have exclusive jurisdiction.
11. Contact
